Someone has just been arrested — what should we do first?
Ask which police station the person is held at and what the charge is, and contact an attorney. The arrested person has the right to remain silent and the right to legal representation. Call us with the station and the charge.
What is bail?
Bail is money paid so that an accused person can be released while the case continues, on condition that they return to court. For some less serious offences the police can grant bail at the station before the first court appearance, or release a person on a warning; otherwise bail is applied for in court. Whether bail is granted, and how much it is, depends on the charge and the circumstances.
Can I claim for an unlawful arrest?
If you were arrested or detained without lawful grounds, you may be able to claim damages from the Minister of Police. Strict time limits apply, so speak to an attorney early.
