What is the difference between an opposed and an unopposed divorce?
An unopposed divorce is one where both spouses agree on everything — the division of assets, the arrangements for children and maintenance — and record it in a settlement agreement. An opposed divorce is one where they do not agree, and the court decides the disputed issues. An attorney can advise which applies to you.
Do I need an antenuptial contract?
If you marry without one, South African law places you in community of property by default. An antenuptial contract must be signed before a notary before the wedding (and then registered in the Deeds Office) if you want to marry out of community of property, with or without accrual.
Can I apply for a protection order myself?
Yes. You can apply at your nearest Magistrates Court. An attorney can help you prepare the application or represent you if the order is opposed.
